What is an H-1B Visa

The H-1B visa allows U.S. companies to bring highly skilled professionals from around the world to fill specialized roles. These positions often include fields such as technology, engineering, finance, healthcare, and education, among others.

The H-1B Sponsorship Process​

 

  • Assess Eligibility

 

Confirm the job meets the definition of a specialty occupation and that the candidate possesses the required education or experience.

 

  • Register for the H-1B Lottery (if applicable)

 

Cap-subject petitions require registration in the annual H-1B lottery each March. Only those selected may submit a full petition.

 

  • File a Labor Condition Application (LCA)

 

Submit the LCA to the U.S. Department of Labor to ensure compliance with wage and working condition requirements and maintain a public access file.

 

  • Submit H-1B Petition

 

File Form I-129 with USCIS, along with all supporting documentation for the prospective employee.

 

  • Approval and Employment Start

 

Once approved, the employee may begin work according to the dates specified on the approval notice.

Responsibilities of H-1B Employers​

 

As an H-1B sponsor, employers are required to:​

 

  • Pay the prevailing wage for the position

  • Ensure the employee works only in the locations and role described in the petition, or file an amendment if changes occur

  • Maintain a public access file to document compliance

  • Notify USCIS of any significant changes in employment
