Who Can Sponsor A Family Member

 

U.S. Citizens may petition for:

  • Spouses

  • Children (unmarried or married, of any age)

  • Parents (if the citizen is 21 or older)

  • Siblings (if the citizen is 21 or older)

 

Lawful Permanent Residents (Green Card Holders) may petition for:

  • Spouses

  • Unmarried children, including adult sons and daughters

 

How Family Members Obtain A Green Card

 

Family-based cases generally proceed in one of two ways:

  • Adjustment of Status:
    For eligible relatives already in the U.S., allowing them to apply for a green card without leaving the country. Applicants may qualify for work and travel authorization while their case is pending.

  • Consular Processing:
    For relatives living abroad, who complete the immigrant visa process at a U.S. embassy or consulate before entering the U.S. as permanent residents.

K-1 Fiancé'(e) Visa

 

The K-1 visa allows U.S. citizens to bring a foreign fiancé(e) to the United States to marry. The couple must meet specific eligibility requirements, including having met in person within the past two years and marrying within 90 days of arrival. After marriage, the foreign spouse may apply for a green card.
