EB-2 National Interest Waiver (NIW)

What Is the EB-2 National Interest Waiver?

The EB-2 National Interest Waiver (NIW) is an employment-based immigrant visa that allows certain professionals to apply for a green card without employer sponsorship or a labor certification. Instead of relying on a job offer, you must show that your work has substantial merit and national importance to the United States.

Who Qualifies?

The NIW is available to:

  • Professionals with an advanced degree, or

  • Individuals with a bachelor’s degree plus at least five years of progressive experience, or

  • Individuals who can demonstrate exceptional ability in their field

Eligible applicants may include engineers, healthcare professionals, researchers, entrepreneurs, business professionals, educators, IT specialists, and other experts whose work benefits the United States at a national level.

What Is the Process?

  1. Eligibility & Strategy Review – A detailed evaluation of your education, experience, and impact.

  2. Petition Preparation (Form I-140) – Submission of evidence and a structured legal argument demonstrating:

    • Your work has substantial merit and national importance

    • You are well positioned to advance the proposed endeavor

    • It benefits the U.S. to waive the job offer requirement

  3. USCIS Review – The government may approve, issue a Request for Evidence (RFE), or deny.

  4. Adjustment of Status or Consular Processing – If approved and a visa number is available, you may apply for permanent residence.

Why Choose Geofrey M. Law for Your NIW

An EB-2 National Interest Waiver is not reserved for PhDs or academics. It is for professionals whose work has real impact — in business, healthcare, technology, education, engineering, public service, and beyond.

Whether you hold a bachelor’s degree with progressive experience, an advanced degree, or substantial professional achievements, the issue is not your title — it is how your work is positioned under the law.

USCIS does not approve NIW petitions based on potential alone. They evaluate evidence, structure, and credibility. Weak framing leads to Requests for Evidence (RFEs). Poor strategy leads to denials.

At Geofrey M. Law, we build NIW cases to withstand scrutiny.

Every petition I prepare is structured as a clear legal argument aligned with the governing framework. I anticipate common challenges, address evidentiary gaps before filing, and present your qualifications in a way that demonstrates both past achievement and future national importance.

If you have received an RFE, your response must be precise and strategic — not reactive. If your case was previously denied, the solution is not simply refiling; it is rebuilding the argument correctly.

Your experience, innovation, and expertise deserve serious representation. I approach every NIW petition with the level of preparation, rigor, and strategic thinking it demands.

If you are ready to present your work with clarity and force, I am prepared to build a petition designed to win.
