¿Qué es una Visa T?
La Visa T es una forma humanitaria de alivio migratorio para personas que han sido víctimas de trata de personas, incluyendo la trata laboral y la trata sexual. Fue creada para proteger a las sobrevivientes y brindarles una salida legal tras la explotación.
Mediante la Visa T, los sobrevivientes pueden permanecer en Estados Unidos, obtener autorización de trabajo, acceder a ciertos beneficios y servicios, y eventualmente solicitar la residencia permanente legal (tarjeta verde). Lo más importante es que la Visa T les permite comenzar a reconstruir sus vidas con seguridad e independencia, libres del control de los traficantes.
¿Quién puede calificar para una Visa T?
Usted puede ser elegible para una Visa T si:
Es víctima de una forma grave de trata de personas, incluida la trata laboral o sexual.
(Nuestra firma representa principalmente a víctimas de trata laboral que fueron explotadas por sus empleadores).Están físicamente presentes en los Estados Unidos debido a la trata
Han cumplido con las solicitudes razonables de las autoridades policiales para ayudar en la investigación o el enjuiciamiento de la trata.
(Este requisito puede no aplicarse en el caso de menores o sobrevivientes que no puedan cooperar debido a un trauma).Sufriría dificultades extremas que implicarían daños inusuales y graves si fuera expulsado de los Estados Unidos.
También se pueden incluir ciertos familiares calificados, lo que permite a los sobrevivientes proteger a sus seres queridos y permanecer juntos.

The H-1B Sponsorship Process

Assess Eligibility
Confirm the job meets the definition of a specialty occupation and that the candidate possesses the required education or experience.

Register for the H-1B Lottery (if applicable)
Cap-subject petitions require registration in the annual H-1B lottery each March. Only those selected may submit a full petition.

File a Labor Condition Application (LCA)
Submit the LCA to the U.S. Department of Labor to ensure compliance with wage and working condition requirements and maintain a public access file.

Submit H-1B Petition
File Form I-129 with USCIS, along with all supporting documentation for the prospective employee.

Approval and Employment Start
Once approved, the employee may begin work according to the dates specified on the approval notice.
Responsibilities of H-1B Employers
As an H-1B sponsor, employers are required to:

Pay the prevailing wage for the position

Ensure the employee works only in the locations and role described in the petition, or file an amendment if changes occur

Maintain a public access file to document compliance

Notify USCIS of any significant changes in employment
